While the last of the existing citations are being marked-up, a new case was added today. The case involves a lawsuit brought by a Chicago documentary filmmaker that sued the makers of the show the “The PJs.”÷šBasically, he claimed that he made a documentary about life in Chicago’s projects (which he sent to Oprah’s production company) and that the makers of the PJs based their characters on people in his film. Interestingly, the defendants sought dismissal, not on a claim that they did not copy the film, but that÷šwhat they copied÷šwere “facts” that÷šwere free to be copied.÷šFirst, even if the characters were facts that could be copied freely, the makers of the PJs should have been decent enough to pay the guy for using his film as research for the show. Anyway, the case is Murphy v. Murphy (No. 2004-F271-11220001).÷š÷š

After tagging several cases there are a few things about legal citations that complicate tagging choices:

• In-text citations vs. stand-alone citations. The real issue here is the future ability to strip citations out of the data for various purposes (e.g., natural language processing, alterative presentations of the data, etc.). Placing tags around stand alone citations is pretty straightforward, many citations are woven into regular text preventing any obvious way to remove them without leaving a non-sensical sentence fragment behind. 
• Parallel citations. Tagging a citation when only one source is given in the orignal is obvious but parallel citations, where multiple alternative citations are given complicates the process. Preference should obviously be given when only one of the alternatives includes a pinpoint cite, but the choice is less obvious in other circumstances. Should the tagging accomadate the multiple sources or should there be a pre-set preference (e.g., first cites, official reporters, West cites, etc.)?   
• Subsequent history citations (e.g., cite denied, etc.) and other citations nested in a parentheical (e.g., “(quoting X v. Y, …)”). These citations can be ignored for tagging purposes but that would result in lost data for future features for navigating through citation networks. Tagging the citations in separate fragments is also problematic because data is lost on the complete citation (e.g., parenthetical text can be useful in giving context and value to a citation). The final solution may be to introduce a new attribute or sub-element (or allow nesting) to the original citation to reflect the sub-citation.

One of the side benefits of the new citation tagging system is that it allows for the compilation of a list of the most frequent citations. Among other uses, such a list can allows for new cases to be added based on connections to other documents already in the database. It’s sort of like a court opinion version of the Kevin Bacon game. The use of linking citations between cases in the OpenGavel database had been put off until a workable process was developed. That process has now been partially implemented. The new system allows any citation to be coded in the underlying xml (RAW file). Here is an example:

When the XML file is created, each citation is checked against a database of source document citations in the database. If the citation is found an additional attribute is added that contains the file location of the document, for example the above markup would be changed to:

Then when the HTML version of the document is created the script creates a link whereever it finds a cite with a populated ID attribute.

This new system allows data about citations to be added to the underlying markup regardless of whether particular documents have been added to OG. New links are created or removed automatically based on the status of the target document, removing the need to manually manage potentially broken links. The best place to see these new links in action is in the case Bill Graham Archives v. Dorling Kindersley Ltd. Links in other cases will begin to appear over the next few days as the underlying markup is altered. Next steps include (1) adding citation searching (2) incorporating citation information into a general citator feature, and (3) utilizing pinpoint citation information in more targeted links.

a new feature was added to the case name search function—a thersaurus that correlates search terms with case name abbreviations. The abbreviations were taken from The Bluebook: A Uniform System of Citation, Eighteenth Edition (Rule T.6 page 335). Abbreviations for plurals (e.g., “Prods.”) will be added soon. Try it out.

In addition, some search form security issues were addressed and minor bugs were fixed involving search terms that include special characters.
